Estate parking space licence agreement

Parking space licence agreement.

This agreement is between the London Borough of Hammersmith & Fulham ("the council") and the ("the licensee") the person to whom a licence is granted.

1. This agreement is granted subject to the following conditions being fulfilled.

1.1 The council shall be under no liability whatsoever for any injury loss or damage caused by or to the vehicle or by the driver of the vehicle whilst the vehicle is parked or driven on the estate.

1.2 The parking permit issued with this Licence Agreement applies only to the vehicle nominated in the application and is not transferable.

1.3 A valid estate parking permit, issued by the council is clearly displayed on the windshield of the vehicle at all times that it is parked on the estate.

1.4 The parking space is not to be used for the carrying out of repairs to the vehicle save routine maintenance.

1.5 The vehicle will be kept in a roadworthy condition at all times, carry a valid Certificate of Insurance and valid Vehicle Excise Duty Road Tax.

2. In addition, the licensee will:

2.1 Pay the licence fee monthly in advance by Direct Debit only. An advanced payment may be required on sign up, the amount of which will vary on the tenure type.

2.2 Not cause, or given consent to, any other vehicle to be parked on the estate.

2.3 Not park the above-mentioned vehicle in any parking space other than the space allocated to the licensee by the council.

2.4 Not carry out, permit, or allow any action in the parking space which may be, or become, a nuisance, hazard, or cause damage or inconvenience to the council or any other person.

3. Notices of variation or termination:

3.1 The conditions of this licence agreement may be varied by the council at any time. Variations will be notified to the licensee, in writing, at least seven days before the variations are due to take effect.

3.2 The council will give four weeks' notice of any change to the weekly licence fee for the parking space.

3.3 In the event of a breach of the terms of this agreement by the licensee, the council may immediately terminate this licence agreement by giving the licensee notice to quit, in writing. Such cancellation by the council of this Licence Agreement will be without prejudice and subject to the rights and remedies of the council in respect of any sums payable.

3.4 Except as in 3.3 above, the council may end this Licence Agreement by giving the licensee notice to quit, in writing, to expire on the Sunday following the date of the notice. This notice will normally give no less than seven days warning of the cancellation of this licence.

3.5 The licensee may terminate this Licence Agreement by giving seven days' notice, in writing, to expire on a Monday following the date of the notice. Cancellation by the licensee of this Licence Agreement will be without prejudice. And subject to the rights and remedies of the council in respect of any sums payable.

3.6 Any notices served on the council by the licensee should be served at Hammersmith Town Hall Extension, King Street, Hammersmith, London W6 9JU.

3.7 Notices served by the council upon the licensee will be deemed served if delivered by hand to the licensee at the address on this agreement or 24 hours after posting to that address.
