Legal requirements for leaseholders wishing to sublet

As a leaseholder you must tell the council if you choose to sublet your property. This is done by serving a Notice of Sublet and paying a fee of £30.

If you don’t tell the council, then you would be in breach of your lease and may also invalidate your buildings insurance. This means that the council could take legal action against you for any damage caused by your tenants and you could also be at risk of losing your property.

You should provide the following:

1. A Notice and Fee

The notice can be just a letter telling us of your intention to sublet. Please send it to:

The fee of £30 (this includes VAT) should be paid by cheque for each notice being served, made payable to ‘London Borough of Hammersmith & Fulham’.

2. A copy of the Tenancy Agreement

This should include:

  • Full names of all tenants
  • Commencement date and term of tenancy
  • Your contact details including correspondence address, email address and telephone number
  • Address where service charge demands are to be sent

3. Details of Managing Agents

If you are using a managing agent, please also provide:

  • Their contact details, including telephone number, email and postal address
  • Confirmation of whether invoices are to be sent to your managing agents and if they are also responsible for payment

Each time your tenants change a new notice must be served, with another fee. Changes to your correspondence details don’t require a new notice to be served but Leasehold Services must be notified in writing.
