Public Spaces Protection Order to support responsible street entertaining, busking and amplified public speaking in public spaces 

We've introduced a Public Spaces Protection Order (PSPO) in the area outside Shepherds Bush Station (Central Line), to tackle noise nuisance from busking, street entertainment and amplified public speaking. 

We consulted widely on this issue over spring 2016 and the overwhelming response was that something should be done to address noisy busking, street entertainment and amplified public speaking outside Shepherds Bush Station. After further consultation in Summer 2019 this order was extended for a further three years.  

What are the restrictions? 

The activities described below are prohibited from 23 June 2019, outside of the hours of 10am and 6pm: street entertaining, busking and public speaking.

1. Restrictions: 

  • you are prohibited from street entertaining, busking and amplified public speaking outside of the hours of 10am and 6pm. Within the area shown outlined in red on the attached map 
  • you are prohibited from permitting music or voice to be amplified to a level to be so loud that it can be heard beyond the area shown outlined in red on the attached map 
  • you are prohibited from using mains electricity or generator power for the purposes of amplification 
  • you are prohibited from using microphones, loudspeakers, megaphones, loud hailers or any other similar equipment designed to amplify the volume of speech or music 
  • buskers, street entertainers and public speaking shall not occupy any one location for more than one (1) hour at a time within the area shown outlined in red on the attached map. There shall be no return to the area shown outlined in red on the attached map within any 24 hour period 
  • you are prohibited from busking, entertaining and public speaking within 50 metres of another busker, street entertainer or public speaker. 

It is an offence for a person without reasonable excuse to engage in an activity that is prohibited by this order. A person found to be in breach of this order is liable on summary conviction to a maximum penalty of £1,000 or to a fixed penalty notice of £100 (reduced to £60 if paid within 10 days). 

Why are the powers needed? 

These powers are designed to balance the rights of residents and visitors to enjoy our public spaces, with the need to tackle noise nuisance efficiently.

    Section 59 Public Spaces Protection Order 

    London Borough of Hammersmith and Fulham hereby makes the following Order:

    No person shall partake in Street Entertaining/Busking/Amplified Public Speaking in the area outside Shepherds Bush station as shown outlined on the attached map other than in accordance with the restrictions below, as defined by the London Borough of Hammersmith and Fulham.

    This Order comes into force on 23 June 2016 for a period of three 3 years.

    THIS ORDER is made by the London Borough of Hammersmith and Fulham (in this order called “the Authority”) because The Authority is satisfied on reasonable grounds that activities carried out or likely to be carried out in a public space, namely the area shown outlined in red on the attached map

    • Have had or are likely to have a detrimental effect on the quality of life of those in the locality
    • Are or are likely to be unreasonable and
    • Justify the restrictions imposed


    The council is satisfied that the following activities have been or are likely to be carried out in the public space: Street Entertaining or Busking or Amplified Public Speaking

    1. RESTRICTIONS:

    • You are prohibited from Street Entertaining/Busking/ Amplified Public Speaking outside of the hours of 10 am and 6pm within the area shown outlined in red on the attached map.
    • You are prohibited from permitting music or voice to be amplified to a level to be so loud that it can be heard beyond the area shown outlined in red on the attached map.
    • You are prohibited from using mains electricity or generator power for the purposes of amplification
    • You are prohibited from using microphones/loudspeakers/megaphones/loud hailers or any other similar equipment designed to amplify the volume of speech or music
    • Buskers/Street Entertainers/ Public Speaking shall not occupy any one location for more than one (1) hour at a time within the area shown outlined in red on the attached map. There shall be no return to the area shown outlined in red on the attached map within any 24 hour period.
    • You are prohibited from Busking/Entertaining/Amplified Public Speaking within 50 metres of another busker/street entertainer or public speaker


    This order will come into force on 23 June 2016 and lasts for a period of three (3) years.

    2. WHAT HAPPENS IF YOU FAIL TO COMPLY WITH THIS ORDER?

    FIXED PENALTY

    A Police Constable, Police Community Support Officer or other authorised person may issue a fixed penalty notice to anyone he or she believes has committed an offence. You will have 14 days to pay the fixed penalty of £100 (£60 if paid within 10 days). If you pay the fixed penalty within the 14 days you will not be prosecuted.

    3. APPEALS

    Any challenge to this order must be made in the High Court by an interested person within six (6) weeks of it being made. An interested person is someone who lives in, or regularly works in or visits the restricted area. This means that only those who are directly affected by the restrictions have the power to challenge. The right to challenge also exists where an order is varied by the council.

    This order shall remain in place until: 23 June 2019
