How to object to a Penalty Charge

If you have received a Penalty Charge Notice (parking ticket, bus lane ticket or moving traffic ticket) and feel it should not have been issued, you have the right to challenge it.

Parking Tickets

If you have received a PCN for a parking contravention, you can make a formal representation when you receive the Notice to Owner form. This is sent if the ticket has not been paid within 28 days from the date it was issued. 
 
You can, however, write to us before you receive a Notice to Owner. 

• If you write to us within the 14 day discount period, we will take that into account when we reply to you. If we do  not agree the ticket should be cancelled, we will extend a discretionary discount period.
• If you write us after the discount period has expired, you will be liable for the full Penalty Charge.            

Bus Lane tickets

If you have received a PCN for a bus lane contravention, you can make a formal representation when you receive the Enforcement Notice form.  This is sent if the ticket has not been paid within 28 days from the date it was issued. 
  
You can, however, write to us before you receive an Enforcement Notice. 

• If you write to us within the 14 day discount period, we will take that into account when we reply to you. If we do  not agree the ticket should be cancelled, we will extend a discretionary discount period.
• If you write us after the discount period has expired, you will be liable for the full Penalty Charge.            

Moving Traffic violations

If you have received a Penalty Charge Notice for a moving traffic violation, the PCN includes the form you need to use to make formal representation against the PCN.  

Representation

"Representation" is the term used for a formal challenge to a PCN. The representation form lists the grounds on which you can make a representation.

If you have challenged a parking or bus lane PCN before receiving a Notice to Owner/Enforcement Notice, and we have not agreed that it should be cancelled, you can still make representation when you receive the Notice to Owner/Enforcement Notice.  

If you want to continue to challenge your PCN, it is important that you complete your representations form when you receive it, and return it to us.  If you do not do this, you will lose your chance to refer the case to the Independent Adjudicator. We will respond to your representation by either cancelling the PCN or by sending you a Notice Rejection of Representation.

If we reject your representation, we will send you a form so that you can refer the case to the Independent Adjudicator.  At this stage, you can then either pay the full penalty charge or make an appeal to the adjudicator.
