UDP Extension of Saved Policies beyond 27 September 2007

Details of development plan policies to be used prior to the adoption of the Local Development Framework (LDF)

Hammersmith and Fulham UDP as amended in 2007 

The Planning & Compulsory Purchase Act 2004 provided for the saving of policies in adopted unitary development plans for a period of 3 years from the commencement of the Act, which was 28 September 2004. The Hammersmith and Fulham Unitary Development Plan was adopted in August 2003. Since this fell before the date that Section 38 of the 2004 Act came into force, all the policies in the UDP would have expired on 27 September 2007, unless we received the approval of the Secretary of State to extend them. 

On 19 March 2007, the Council agreed those policies in the Unitary Development Plan that it wished to extend beyond the 3 year period and those that it considered could expire.  A schedule (387kb pdf) identifying policies that the Council wished to be extended was submitted to the Secretary of State in accordance with a protocol issued by the Department for Communities and Local Government. The Secretary of State  considered the Council request and on 27th September issued a direction under paragraph 1(3) of schedule 8 to the Planning and Compulsory Purchase Act 2004 to extend the life of certain saved policies. The policies that have been extended beyond 27 September 2007 will be used together with the London Plan as the statutory development plan for the borough from the 28 September 2007 and will be used to assess planning applications until the the adoption of the borough's Local Development Framework. LDF documents are programmed for adoption in 2009 and 2010.
