GENERAL INFORMATION
London Tenders Portal (the "Portal")
Most of the Council's tendering exercises will be undertaken through the London Tenders Portal (new window), and all communications will be managed through it. Where the Portal is being used you must register an interest on it in order to participate (registration is free). Approximately a third of the London boroughs also subscribe to using the Portal and by registering you will also receive email notifications of other relevant opportunities as and when they arise from the participating organisations (as listed on the Portal). The above link can be used for those who are already registered or organisations registering for the first time. If you are registering for the first time on the Portal the system provides a Supplier Registration Wizard and you will need to complete each step. Once you have completed your registration application form it will be reviewed. If another person within your organisation has previously registered an interest on the system your application will be rejected and an e-mail explaining why will be sent to you. You will need to contact that person within your organisation that is already registered and have them set up an account for you. Once your application has been accepted you will receive an email informing you of this and giving you a username and password, you will then be able to access this opportunity (and others that may be on the system).
Please note that when submitting any completed Pre-Qualification Questionnaire (also known as a PQQ) or tender through the Portal that the process is not instantaneous. It depends upon the size of the document(s) you are uploading and the broadband width and speeds provided by your Internet Service Provider (not the Council or the provider of the Portal). Therefore, you must allow sufficient time for the process to be completed as late receipt of questionnaires or tenders (even by as much as 1 second) will be identified as arriving late and therefore cannot and will not be considered.
Equalities and Health & Safety
Due to the nature of some of the contracts to be awarded, it may be appropriate for you to familiarise with the appropriate guidance and/or Codes of Practice that are currently in force and issued by the Equality and Human Rights Commission (new window) set up by the UK Government. Where appropriate, it will be a condition of contract that the successful contractor will be required to comply with this advice and the Council's Equal Opportunities Policy (new window).
The Council's requirements may include contractors and services providers to demonstrate a compliance of Health & Safety legislation. The Council recognises the accreditation afforded by the Contractors Health and Safety (CHAS) Scheme (new window) (although there are equivalents detailed on the Safety Schemes in Procurement Forum - SSIP - website) (new window).

Creation of a Mutual Joint Venture Company to deliver School Support Services
The Council is considering the establishment of an employee led mutual company to deliver support services to schools (ICT, Financial Advice Schools Information Management) and services to the Local Authority (Schools assets and regeneration, Schools funding including schools financial management and schools resources strategies). As part of the procurement process the Council will be seeking an innovative independent sector partner (ISP) to participate and invest in the creation of a Mutual Joint Venture Company. To this end it is envisaged that the ISP will take responsibility for the creation of the joint venture company, whose shareholding will be shared between the ISP and the employees (held on the employees’ behalf in a trust). The Council will have a contractual arrangement with the Mutual Joint Venture company to provide some of the services, supplies and works listed below (and further defined in the further information document) for a period of not less than 4 years. The specific shareholding required by the ISP will be subject to the dialogue undertaken as part of this process, although the maximum share for any independent sector partner will be limited to balance ownership in favour of employee ownership. The Council is working closely with the Royal Borough of Kensington & Chelsea and Westminster City Council, and it is intended that staff from all three boroughs will be transferred into the Mutual Joint Venture company under the 2006 TUPE Regulations.
The Council is procuring on behalf of education bodies within the Boroughs of Hammersmith & Fulham, Kensington & Chelsea and Westminster for an independent partner to set up the Mutual Joint Venture Company. There will be a single client-side arrangement between the Council and the Mutual Joint Venture. The primary purpose of creating a mutualised company is specifically to undertake the following services, supplies or works to “relevant educational establishments” defined below within the boroughs commissioned either by the Council or the governing bodies of these establishments. The relevant educational establishments collectively mean:
- educational facilities (which will include primary and secondary schools and may include tertiary education);
- other children's facilities (including but not limited to after school club facilities, youth clubs etc);
- accommodation for adult education and Special Educational Needs (SEN) education;
- community facilities whether co-located with any of the above facilities or freestanding (including but not limited to halls, drop-in centres, crèches, sheltered workshops etc).
As a commercial organisation the Mutual Joint Venture will also offer its services to non-maintained schools, such as Academies and Free schools. The services, supplies and works to the relevant educational facilities will include either direct provision by the Mutual Joint Venture company or the sub-contracting to other providers. The scope of the services, supplies and works to the relevant educational facilities may include:
- (i) information communication and technology ("ICT") services;
- (ii) ICT supplies
- (iii) architectural services;
- (iv) engineering services;
- (v) construction related works, supplies and services including lifecycle planned maintenance and reactive maintenance);
- (vi) security services;
- (vii) building services;
- (viii) hard facilities management services (e.g. building fabric and mechanical installations);
- (ix) soft facilities management services (e.g. catering, cleaning, security, and health & safety);
- (x) educational support services;
- (xi) educational strategy services; and
- (xii) consultancy services (procurement projects e.g. free school meals)
The Council wishes to hear from the market on the options available for the creation of the employee led mutual company. Further information and draft selection criteria will be available through the London Tenders Portal. We are seeking feedback on this information from the market. A Meet the Buyer's event is scheduled mid January 2012 at Hammersmith Town Hall which will include key note speeches from lead councillors and the Minister for the Cabinet Office and Paymaster General (date is subject to availability). The purpose of the further information provided and Meet the Buyer's event is to provide feedback to the Councils that will be used to further influence the structure of the specification before the publication of the Contract Notice. Reserving a place at the event should be made through the London Tenders Portal and any questions that Economic Operators intend to ask at the event should be submitted in advance to the Council through the London Tenders Portal.

Invitation to Quote for Continuity of Care (Closing date: 03:00 hrs 7 February 2012)
The Council's local partnership programme "Continuity of Care" is all about improving peoples' experience of health and social care support and making better use of resources across the health and social care economy. We have identified that in Hammersmith & Fulham we make disproportionately high use of nursing home placements for older people and we are outliers in comparison to other London boroughs. Our target is to change our policy and practice so that we support and care for more people in the community.
To support this we want to engage with identified stakeholders and parties to understand the behaviours that influence a decision to place someone in a nursing home. Then, as a result of findings from that engagement to design a set of solutions captured in an implementation plan that will enable the council to influence and change these behaviours to achieve our objectives.

Hammersmith & Fulham Tennis Centres (Closing time & date 03:00 hrs 23 Feb. 2012)
An exciting opportunity to secure premises, under long leases, for the management, maintenance and development of tennis centres across three sites in partnership with the Council.
The Council invites tenders from operators with relevant experience and expertise in providing coaching and promoting community tennis as well as running tennis centres in parks across the borough (Ravenscourt Park, Hurlingham Park and Eel Brook Common). This is being run through the London Tenders Portal (see instructions above) as an "Open" tender, there is no pre-qualification procedure. The closing time and date for receipt of tenders is 03:00 hrs on Thursday 23 February 2012.

Framework Agreement for the provision of a Generic and Specialist Advocacy Services and Mental Health User Involvement Services (Closing time & date 24 February 2012).
There is an exciting opportunity for providers with the ability to provide high quality Advocacy and User Involvement Services to express an interest in being part of a new Framework Agreement to supply services to six London Boroughs namely Brent, Hammersmith and Fulham, Hillingdon, Hounslow, Westminster City Council and the Royal Borough of Kensington and Chelsea
The Advocacy Services are being commissioned with an outcomes focus which will aim to achieve the goals, aspirations, and priorities for individual Service Users. The service will be broken down into one generic and three specialist lots:
- LOT 1: Generic Advocacy
- LOT 2: Specialist: Learning Disability Advocacy
- LOT 3: Specialist Mental Health Advocacy
- LOT 4: Service User Involvement: Mental Health
Providers can apply to provide services in any or all of the Boroughs for one or more of the lots
The Council is working collaboratively with the named London partners will lead the procurement process. The Framework Agreement will be for a duration of four years from Summer 2012, aiming to begin implementation of new services from August 2012 onwards. . The Framework will allow all six boroughs to use the service at any time during this four year period. Timing and volumes will differ for each Borough. There are no guaranteed volumes but an indication of current volumes and start dates are provided in the Pre-Qualification Questionnaire (available through the London Tenders Portal). Consortia bids are welcome.
The successful providers, working in partnership with individuals and Councils, will ensure that individuals are given more flexibility, control and opportunities to have their voices heard and their concerns advocated for. The types of services which can be provided are as follows;
- Set up and deliver an independent, confidential, high quality professional advocacy services and mental health service user involvement services to residents of the six councils, aged 18 years who are eligible for adult social care services.
- Short term, issue based and ‘crisis’ advocacy to ensure that a professional advocate speaks up in the best interests of the referred person about a particular issue they have, including when significant decisions are needed urgently.
- Support for mental health service users to ensure that they are meaningfully involved in their care, service developments and commissioning processes.
- Provide professional advocacy and support for user involvement that is independent of those commissioning or providing health or social care services.
- Raise awareness to the providers and commissioners about particular issues faced by users of the independent professional advocacy service and the user involvement service, including the concerns of specific sub-groups of users who might be finding it difficult to engage with services.
- Support people to identify and represent their own concerns and views directly to the statutory bodies.
- Establish links and work co-operatively with other agencies, both statutory and voluntary providing services, including other providers of advocacy services in the boroughs.
- Provide service users with information on local services and signposting them to other services when these are more appropriate.
- The services should also have agreed mechanisms to communicate collective, significant or recurrent matters of concern to service providers and commissioners.
