The Licensing Act 2003

The Licensing Act 2003 requires any premises within Hammersmith & Fulham providing licensable activities to have a premises licence.

The council of the London Borough of Hammersmith and Fulham hereby give notice that pursuant to section 5 of the Licensing Act 2003, on 27th October 2010 the council determined its policy in respect of its licensing functions for the period 2011 to 2014. This policy (known as its statement of licensing policy) has been published and will come into effect on 7th January 2011 upon which the existing statement of licensing policy will cease to have effect. The act came into force on 7 November 2005. 

Licensable activities that now need a premises licence include:

  • the sale or supply of alcohol
  • regulated entertainment
  • late night refreshment


Statement of Licensing Policy

The new law also requires us to publish a Statement of Licensing Policy. This policy will be used as a guide in decision making with regard to licensing matters. All of our decisions under the act will be based on four licensing objectives, which are:

  • the prevention of crime and disorder
  • public safety
  • the prevention of public nuisance
  • the protection of children from harm

The Council of the London Borough of Hammersmith and Fulham hereby give notice that on 29th June 2011 a decision was made to adopt a special licensing policy for the Shepherd’s Bush area which came into effect on the same day. Please be advised that pursuant to section 5 of the Licensing Act 2003 the Council’s statement of licensing policy will now be amended to included this additional policy. 

If you wish to make a representation to any application, you must be able to demonstrate that the granting of it would undermine one or more of the licensing objectives. The licensing objectives are:

  • The prevention of crime and disorder
  • Public safety
  • The prevention of public nuisance
  • The protection of children from harm

Copies of all representations will be forwarded to the applicant. Anonymous representations will not be accepted by the Licensing Authority. Only under exceptional circumstances will the Licensing Authority not disclose ANY personal details. This means that your name, as a minimum, will be made public and in some instances the street name. References to the house number, telephone numbers and email addresses will be removed.

Please be aware that you will be invited to attend in person to a hearing should the licence application have to be determined by the Council's Licensing Sub-Committee. Your representation will also be included in the papers presented to the committee and therefore will pass into the public domain. It is therefore possible that details of your representation may be picked up by journalists. Further information on making a representation can be obtained at the following link.
