How to report a planning control breach

You can submit enforcement complaints online, Report a planning control breach (online form)

When you report a breach to us, you will need to give the following information:

  • address of the property
  • description of the breach
  • the objection you have and what harm, if any, it is causing
  • when the breach began
  • details of the owners of the property (if known to you)
  • your name, address, telephone number and email address.

Once we have received your report of a breach we will take the following action:

  • send you acknowledgement within five days
  • give you the name of the Planning Enforcement Officer who is investigating your report
  • give you a case number for your report
  • consider every case carefully and consider what action could be taken
  • if we think the matter should be dealt with by another section of the council we will inform you and ask that section to look at your report and advise you further
  • an enforcement officer will visit the site you are complaining about and may also need to visit you
  • advise you of the outcome of our investigation in writing                 

The Investigation Process

The planning enforcement process is not straightforward and is often lengthy. Case officers will always try to negotiate informally with the parties who have done the works before, as a last resort, recommending that enforcement action is taken. The officer dealing with your report will need to make a site visit (or a number of visits) to find answers to a number of questions.

The council may not be able to take enforcement action or may take a course of action you do not agree with. Enforcement action will only be taken where the breach of planning control is serious and causing local harm.
